CHATTANOOGA TIMES FREE PRESS / A Hamilton Place mall pet store will find out in a matter of days if the Tennessee Department of Agriculture will allow it to keep selling pets or if violations to the state code of animal care could lead to the suspension of the store’s license.
The Pet Company gained unwelcome attention June 15 when the city of Chattanooga raided the store, removed all its animals and slapped it with 90 violations of local city ordinances that deal with animal cruelty.

Tuesday night, Metro Council unanimously banned the outdoor/roadside sale of domestic animals, such as cats, dogs and small “pocket” pets within Nashville.
The bill was sponsored by councilwoman Karen Bennett of Inglewood, who is also the founder of Freedom Farm Animal Sanctuary in Hendersonville. According to a statement she gave The Tennessean, the ban “should give some animals a better shot at healthy lives and reduce the number of situations in which people adopt animals that haven’t been treated properly.”

ORDINANCE NO. BL2009-606 (BENNETT) – This ordinance amends the Metro Code to prohibit the outdoor sale of animals. The code already prohibits mobile vendors from selling goods or wares along the roadside, which includes animals. However, there is no specific provision applicable just to animals.
This ordinance, modeled after an ordinance in Lebanon, Tennessee, would prohibit the outdoor sale or gifting of dogs, cats, or other domestic animals in any outdoor public place. Included within the definition of “outdoor public place” are public rights-of-way and public or private parking lots. The ordinance exempts the Metro health department and 501(c)(3) nonprofit organizations whose primary purpose is the care and adoption of animals. The ordinance also exempts persons selling or giving away animals on their own property.

We’ll fortunately no longer be seeing puppies and kittens sold along Lebanon’s roadsides. The city council voted on May 5 in favor of a new law to ban the sales within Lebanon city limits. (more…)
